What does Roe v. Wadereveal about the intersection between the history of the women’s rights movement and the core idea that all Americans have the right to life, liberty, and the pursuit of happiness?

Unit 11 Discussion –

Birth Control and the Right to Privacy

By primarily invoking the 4th Amendment to the U.S. Constitution, the U.S. Supreme Court made a landmark decision in 1973 in Roe v. Wade, ruling that American women have the right to have an abortion. Roe v. Wade represented the culmination of several federal cases and laws regarding women, sexuality, and reproductive rights, beginning with the Comstock Act of 1873, which made circulating “Obscene Literature and Articles of Immoral Use” illegal. Congress unequivocally targeted the use of contraceptives in this law, which classified information about contraception as “obscene literature.” Further, Congress empowered the U.S. Postal Service to confiscate and report on any information about contraceptives and/or birth control devices sent by U.S. mail. Despite protests from reproductive rights activistsincluding the vociferous birth control advocate Margaret Sangerto overturn the Comstock Law, over fifty years passed before Judge Grover Moscowitz of the U.S. District Court, Southern District of New York, overturned the law, ruling in 1938 that the prescription and importing of contraceptives by physicians for the health and well-being of their patients is legal. The U.S. Circuit Court of Appeals for the Second Circuit affirmed Judge Moscowitz’s decision.

The Supreme Court did not begin to fully overturn the Comstock Law until nearly one century after its passage, when the Court ruled in Griswold v. Connecticut (1965) that the U.S. Constitution protects the use of birth control. This landmark Supreme Court decision officially legalized the use of contraceptives by married couples to control reproduction by classifying the use of birth control as a right to privacy issue protected by the U.S. Constitution. (Per the Fourth Amendment, a bedroom is a private place that in theory requires a warrant for intrusion.) Seven years later, SCOTUS recognized the reproductive rights of all Americans in Eisenstadt v. Baird (1972), which legalized the purchase and use of contraceptives by unmarried Americans.

QUESTIONS:

  1. Read the above excerpt from the draft of the opinion for Roe v. Wade (1973) composed by Associate Justice Harry Blackmun. (Chief Justice Warren Burger penned the handwritten comments in the opinion.) Why did the Supreme Court invoke “right to privacy” as the main tenet to legalize abortion in Roe V. Wade?
  2. The controversial Roe v. Wadedecision has incited bitter debates and even violence over the past fifty years. One major reason why Roe v. Wadewas and remains tendentious is because the decision required SCOTUS to determine when personhood begins, which has major legal, medical, moral, and philosophical ramifications. SCOTUS determined that viability begins at twenty- three weeks in the womb. Why did so many Americans disagree with this?
  3. What does Roe v. Wadereveal about the intersection between the history of the women’s rights movement and the core idea that all Americans have the right to life, liberty, and the pursuit of happiness?

summarize three (3) empirical (primary research) studies that have evaluated how effective the policy has been in achieving its goals (the policy’s efficacy).

Professor’s Instructions:

For the capstone research paper, you will write an 8-10 page paper (excluding the title page, reference page, tables, and figures) about the approved policy you selected at the beginning of the semester (Capstone Paper Topics). The purpose of this paper is to provide a synopsis of the policy’s background/history, purpose, goal(s), implementation, and efficacy; thus, the following information must be included within your paper:

a description of the policy and the scope of the problem (e.g., statistics) the policy is trying to address;

a discussion of the history of the policy, including why, where, and when it was created;

a discussion of the purpose(s) or goal(s) of the policy (i.e., what it is designed to accomplish, who or what it is targeting).

In addition, you must summarize three (3) empirical (primary research) studies that have evaluated how effective the policy has been in achieving its goals (the policy’s efficacy). For each study, include the following information:

a summary of the research question examined,

a summary of the population/sample examined,

a summary of how the data were obtained and what data were obtained (i.e., the specific type of information collected),

a summary of the findings as they relate to your thesis statement, and

a brief discussion of any significant limitations to the findings.

All information contained in the paper must come from academic sources and the focus of these sources must be on the US (do not include research from other countries as this is a US policy paper). You must include/cite at least 10 academic sources (e.g., journal articles, law reviews, academic books, research reports, encyclopedias, etc.), at least five (5) of which must be published in academic journals (subject to peer review). Do not include theses or dissertations.

Your paper must be written in APA format (7th edition) and must include proper APA citations. Failure to include citations constitutes plagiarism. Your paper must also include an APA formatted title page and reference page.

Structural Elements of the Capstone Research Paper

Policy reports may reflect different roles that policy analysts commonly play, i.e., from researcher to advocate. The type of paper you are writing is one that is action/advocacy oriented (but based purely on evidence from academic sources and not opinion). The capstone research paper must be structured using the following sections:

Title page (APA formatted, 7th edition) – template available

Introduction (brief description of policy, purpose/goals, targeted population, components, etc., include thesis statement)

Background (history/origins of policy, scope of policy, importance and prevalence of problem)

Implementation (where, when, and why policy was created; policy’s full purpose/goals, what is it designed to accomplish/achieve, and what target population benefits from it)

Research (summary and discussion of 3 primary research studies evaluating the policy’s effectiveness/efficacy; collective discussion of research findings, have researchers found the policy to be effective in accomplishing its purpose/goals). Note primary research studies must contain a methodology and results section. If a source does not include these sections, it is not a primary research study.

Recommendations (based on your research what changes need to be made, what is working, what is not working, include all points of view and perspectives; then, make recommendations for improvement to the legislature/law makers)

Conclusion (brief summary of findings, outcomes, and final take away message from your policy research/review; policy implications, future directions, and expectations)

Reference page (APA formatted, 7th edition) – sample available

Formatting

Papers must be formatted using Times New Roman 12-point font; double-spaced; left alignment, 1″ page margins all around, page numbers in the upper right header. Paraphrase in your own words and make sure to proofread your paper for mechanics and grammar.

Assessment Brief

The systematic review could be structuring as follow, remember it is a recommendation

Title it needs to be narrow and formulated based on PICO.

Abstract (200-300 words) should be structured as follows:

·       Back ground: One or two sentences about the intervention

·       Aim: Main aim using PICO

·       Method: Databases used for search, study design and outcomes you are interested in.

·       Results: Total number of studies with total number of patients, as well as the results of the outcomes reviewed

·       Conclusion: Main conclusion from the Systematic Review.

Key words: 4- 5 keywords.

The introduction (~200-300 words)

·       Should have a brief back ground about the therapeutic intervention and how it works and present a rationale for selection of this therapeutic intervention.

·       What are the gaps in the previously done SR, and why yours will be different.

·       The introduction should end by the aim of the systematic review (i.e. clear PICO question with clear outcomes).

The method (~500-600 words) should include:

·       Search strategy: An appropriate search strategy with at least two databases used. Relevant Keywords and their synonyms.   You need to copy each search strategy from each database. any filters used. Date of search.

·       Inclusion and exclusion criteria. What study design you are looking for is very important. Patients characteristics, what type of treatment they are receiving.

·       N: B. Any language or date restriction needs to be mentioned. i.e. Include the time frame for the search. Also, any language restrictions added, for example studies in English. Also, any language restrictions added, for example studies in English.

·       Outcomes: What are the outcomes that you will look at, how are they defined and how will they be measured?

·       Reviewing process: What is the screening, eligibility and inclusion process that took place.   Have you included open access sources only, or have you tried to contact authors to get access to non-free articles?

·       Data extraction: What data you will extract from each study? e.g. study names, dates, Patient’s characteristics, participants’ numbers, dose, interventions, outcomes, limitations, country where the study was conducted, etc.

·       Assessment of Risk of Bias: You should describe the tool that will be used to assess the risk of bias. For example, if you are looking for RCTs, you will use JADAD score or Consort check list to assess the risk of bias. Cohort and observational studies New Castel Ottawa.

The results (~400-500 words)

·       You must provide a Prisma flow chart as a figure

·       Describe the stages of the Prisma flow charts while referring to the figure of the Prisma flow chart

·       Produce a table of results which compares the findings of each outcome in columns not rows (see examples). Remember the number of the included studies should be the same as by the end of the Prisma flow chart

·       Subheadings are needed for each outcome and you should describe the key results for each outcome under these headings. Do not evaluate the results at this stage and try to avoid describing each study one by one.

·       e.g. an outcome might be ‘mortality’

·       You would write about the mortality findings from all of the studies, but without writing these 1 by 1 as the table highlights this more clearly. For example, 4 studies examining 2000 patients find an increase in the mortality rate after this intervention while 2 studies have no effect on mortality. i

·       The results of the risk of bias of each study. If it is JADAD score or Newcastle Ottawa this is best presented by inclusion in the table. If it is another tool, then this could be written under a subheading.

The Discussion (~700 words)

·       You should discuss the data presented in the results in the table of data extraction

·       You need to evaluate the evidence and critically analyse the effect of the selected treatment on each outcome.   Look closely at each study method and results to evaluate the evidence.

·       Compare your systematic review with other published systematic reviews and other relevant literature.

·       What could be the mechanism (molecular mechanism) of the efficacy and the safety of the selected intervention

·       Consider the limitations of your systematic review. General and subject specific limitation.

The Conclusion (~100 words)

·       Concise conclusion is required to answer the key question about if this intervention is safe of efficient in treating the selected condition or not, your answer should be based on what you have discussed in the discussion and based on the evidence coming from the reviewed studies. It is recommended to propose a future research idea is recommended

·    Avoid using wordy tables, tables should be clear and easily to be read using the relevant abbreviations

·    Present two tables one table for study characteristics and another table for the outcomes

·    All tables should have a number and titles above the table, but the abbreviation list should be below the tables.

·    Figures should have titles and numbers below the figures, as well as the list of abbreviation.

·    Don’t forget to refer to the table and the figures int the text.

Professional issue 3 – Risk management

There are many risks in healthcare. Nurses must be able to safely recognise and assess risks and instigate prevention strategies appropriately. Risk cannot be totally removed from healthcare and incidents may occur occasionally. Nurses must be alert to recognise incidents when they occur and immediate incident management including immediate management and reporting. This scenario provides an opportunity for you to demonstrate safe and effective risk management in line with Standards for competence for registered nurses (NMC, 2018).

You are a newly qualified nurse working in an acute medical ward. You receive handover for a bay of six patients. The health care assistant you are expecting to work with has not arrived on shift yet. Patient 1 (Mr Brown) is frail and confused and is wandering around the ward. The night nurse tells you he has been a nuisance overnight which has prevented her doing much of her work. Patient 2 (Mr Green) has just arrived from the emergency department with pneumonia. The night nurse hands over that he still hasn’t received his first dose of intravenous antibiotics yet. She states that he seemed quite short of breath when she admitted him but hasn’t had a chance to review him as she has been trying to get the Mr Brown back to bed. Patient 3 (Mr Black) is a surgical patient and is due to go to theatre this morning for an appendicectomy. Patient 4 (Mr Grey) has been admitted with acute sickle cell crisis. He is requesting some subcutaneous morphine which is prescribed. You looked after the two other patients yesterday and understand they are in a stable condition. Directly after handover the consultant arrives and asks you to attend the ward round.
