As Frank’s probation officer, what is Jerry’s obligation to the court?

Frank is a 26-year-old male who was court ordered to serve three years of probation for five counts of felony larceny over $500. The summary of the offenses, stated in the pre-sentencing report, indicates that Frank stole game systems and video games from five separate stores over an eight-month period. After the Police Department raided a storage unit based on a tip from an informant that the unit was used as a distribution center stolen goods, mainly electronics, the police arrested 7 adult males and charged them with receiving distribution of stolen merchandise. Information from one of these individuals led to the arrest of 22 additional males, separately charged with larceny and/or distribution. Serial numbers in the game systems were traced to stores from which they were stolen and included dates of theft. Information subsequently led to the questioning of Frank who, after waiving Miranda, confessed stealing the game systems as well as numerous video games and selling the items to others at the storage unit.

Frank dropped out of school during the 8th grade. Along with numerous extended family members, he worked in the fields during harvesting. Although he has citizenship in the US, many of his family members do not. The family usually relocates to Mexico during the winter months, returning for spring, summer, and the first part of fall for field work. They travel between several countries for available work. Frank has never lived away from his parents and siblings.

Information in the pre-sentencing report indicates that Frank’s public defender has asked for a psychological evaluation prior to sentencing because he suspected that Frank was developmentally disabled. Test results indicated that Frank has an IQ of 64. Thus, it is likely that he would encounter difficulties assuming the responsibilities of independent living. Frank’s mother indicated the Frank suffered an illness with a high fever over several days when he was 4 years old. Medical care was not sought. Frank’s mother states that the family looks out for him because he can’t look out for himself. She expressed a concern that other boys have always taken advantage of him, getting him into trouble by telling them to steal things they wanted.

The plea agreement that led to the sentence of probation included a condition that Frank attend a day treatment program for individuals with developmental delays. Other special conditions for probation include prohibiting Frank from associating with other known felon and frequenting liquor establishments.

Jerry has been assigned to be Frank’s probation officer. Although Jerry agrees with the basic premise of the probation conditions, he is concerned that having Frank attend a day reporting program will be difficult when the family depends on the work of all family members to earn a

living. In addition, the family’s lack of permanent residence is like the present difficulties in complying with this condition. However, Jerry explains a requirement to Frank and his mother and father and emphasizes the seriousness of the situation. He also arranges for Frank to start the day treatment program that will transport him to and from his home to the program location every day.

One or both of Frank’s parents bring him to the probation officer reporting as required. Urine screens indicate no alcohol or illegal drug use. After supervising Frank’s probation for 2 months and checking with the case manager at the day treatment program, Jerry determines a Frank is doing well in the program, complying with all the rules, and participating in the small appliance repair training program. Jerry feels more positive of Frank’s chances to be able to fulfill his probation conditions successfully.

Four months into Frank’s probation, Jerry gets a call from the case manager at the day treatment program, informing him that Frank is not attended the program for the past 3 days because he is reportedly ill. When Jerry goes to the family’s residence to inquire about Frank’s illness, he discovers that the parents have not seen Frank for 5 days. They allegedly have no idea where he has gone. After questioning the mother for more information, Jerry discovers that Frank told his mother that people were making fun of him on the transport bus and at the program and that he didn’t want to go to the program anymore. The parents tell Jerry that they did not call him to report Frank’s disappearance because they did not want to get him into trouble with the court. They further report their concern that Frank may be hanging out with people who will get him into trouble. However, they claimed not to know who that might be or where to find Frank. They go on to say that they plan to leave the area soon and will leave without Frank if he does not return home by the following week.

Answer the following questions.

As Frank’s probation officer, what is Jerry’s obligation to the court?

Do you think that Jerry’s responsibility extends to trying to locate Frank? If Frank returns home and reports in with his parents to Jerry’s office within the next 3 days, how should Jerry deal with Frank’s failure to attend the day reporting program?

Should Jerry file a probation violation report because Frank is not attending the program? If Jerry has already notified the court of Frank’s failure to comply with probation conditions for attendance of the day reporting program, should Jerry recommend that Frank be continued on probation, or should Jerry recommend that Frank’s probation be revoked?

Discuss why it is an important issue for your agency by relating its impact on the mission and the objectives of the organization.

Submitting the introductory chapter on a Criminal Justice Topic

The student will then write and submit the introduction chapter and a reference list that will:

  1. Define the relevant organizational problem you have selected to examine. This is a critical first step because the entire staff study is based on the identification of the problem.
  2. Discuss why it is an important issue for your agency by relating its impact on the mission and the objectives of the organization.
  3. Explain how your approach will improve the situation or advance the state of knowledge on the issue.
  4. The introductory chapter requires five types of information:
  • A brief background of the issue.
  • A statement of the problem or objective.
  • Your research questions clearly set forth.
  • Your methods or design discussed.
  • Explain the potential relevance of the findings. Briefly discuss the potential impact of the study and subsequent action plans in terms of personnel, facilities, budget and implementation processes.

5.Lay out your plan of action for obtaining information to solve this problem by listing sources you have identified.

How might a Christian worldview be used to assist in the strategic and operational analysis discussed in this paper?

Prompt: Complete a Strategic and Operational Analysis of your Organization – Part I: Please select an organization that you work for, formerly worked for, or an organization that you can obtain information on (i.e., Apple, American Express, Disney, Intel, Walmart,…etc.) in order to complete a strategic and operational analysis. A strategic analysis begins with a stated objective, such as: “should we enter
an industry with a new service offering?” Complete a Strategic Analysis using (1) Porter’s Five Forces analysis of the target industry structure and (2) SWOT analysis to assess the organization’s strengths, weaknesses, opportunities, and threats in a market. Using Figure 2.1, “Porter’s Five Forces Model,” and Table 2.3, “SWOT Analysis” on pp. 33-34, as an example, you will conduct research on your company and its operating environment to formulate your strategy. The definition of strategic analysis may differ from an academic or business perspective, but the process
involves several common factors:
• Identifying and evaluating data relevant to the company’s strategy
• Defining the internal and external environments to be analyzed
• Using several analytic methods such as Porter’s Five Forces analysis, SWOT analysis, and value chain analysis
Additionally, you will draw (1) a swim lane flowchart, (2) a process flow diagram, and (3) a Gantt chart of a service process within your organization. Your textbook states, “The ability to diagram a process, identify the bottleneck operation, and determine the system capacity are fundamental skills in managing service operations and making improvements. An acknowledged axiom is, ‘If you can’t draw it, then
you don’t really understand it’” (Bordoloi, p. 128). A swim lane flowchart diagrams “organizational activities that cross-functional lines (i.e., the swim lanes) highlighting the handoffs between lanes” (Bordoloi, p. 128). A process flow diagram is a graphical way of describing a process, each of its components, and the order or sequence the process needs to flow. A Gantt chart is one of the most popular and useful ways of
showing activities (tasks or events) displayed against time. Using Figure 5.3, “Swim Lane Flowchart of Graduate School Admissions,” Figure 5.4, “Process Flow Diagram of Mortgage Service,” and Figure 5.5, “Gantt Chart of Mortgage Service” on pp. 127- 130 as examples, you will complete these charts and diagrams with your Strategic, Operational and Project plan in mind.
Include your perspective of operations management in the modern economy and how a Christian worldview affects organizational decision-making. How might a Christian worldview be used to assist in the strategic and operational analysis discussed in this paper?

Analyze salient ethical and legal issues in psychiatric-mental health practice

Ethical and Legal Foundations of PMHNP Care Across the Lifespan

In your role as a PMHNP, you will regularly encounter situations that require your ability to make sound judgments and practice decisions for the safety and well-being of individuals, families, and communities. There may not be a clear-cut answer of how to address the issue, but your ethical decision making must be based on evidence-based practice and what is good, right, and beneficial for patients. You will encounter patients who do not hold your values, but you must remain professional and unbiased in the care you provide to all patients regardless of their background or worldview. You must be prepared to critically analyze ethical situations and develop an appropriate plan of action.

· Analyze salient ethical and legal issues in psychiatric-mental health practice

· Analyze the impact of cultural considerations on ethical/legal decision making in advanced practice nursing

· Evaluate mastery of nurse practitioner knowledge in preparation for the nurse practitioner national certification examination*

Discussion: Ethical and Legal Foundations of PMHNP Care

Advanced practice nursing in all specialties is guided by codes of ethics that put the care, rights, duty, health, and safety of the patient first and foremost. PMHNP practice is also guided by ethical codes specifically for psychiatry. These ethical codes are  frameworks to guide clinical decision making; they are generally not prescriptive. They also represent the aspirational ideals for the profession. Laws, on the other hand, dictate the requirements that must be followed. In this way, legal codes may be thought to represent the minimum standards of care, and ethics represent the highest goals for care.

Develop a linear regression model to explain the variation in the service rating.

Linear Regression Analysis

Terry Downes owns a commercial cleaning company. He has conducted a survey of customers to determine how satisfied they are with the work performed. He devised a 100-point rating scale—with 0 being poor and 100 being excellent service, selected a random sample of 14 customers, and asked them to rate the service. He also recorded the number of worker hours spent in the customer’s facility. These are in the file named Downes.
Use Excel to complete the following:

  1. Develop a scatter plot showing the variables, rate of service and worker hours, with the y variable on the vertical axis and the x variable on the horizontal axis, and indicating the type of relationship.
  2. Develop a linear regression model to explain the variation in the service rating.
  3. Use Word to complete the following:
  4. Describe the model, showing the results of the pertinent hypothesis tests, using a significance level of 0.10.
  5. Submit your work in a Word document and attach your Excel file.
