When probation is a statutory alternative, judges differ in their approach to granting it. Although the recommendation of the probation department would be important-it is difficult to envision too many cases in which judges would grant probation against the recommendation of a probation officer –judges may also seek advice from the police and prosecutor. The geographic area where a court is situated may affect the granting of probation. Social and Political attitudes in rural and urban jurisdictions can differ and thus affect the process, and when the court calendars are crowded, as they are in may urban areas, plea bargaining is more likely to result in probation being granted.
