Advantages of Arbitration for Colossal Corporation Discussion Response

Respond to discussion post:Zayne DavenportArbitration is a form of alternative dispute resolution that is often used as an alternative to litigation in court. It is a process where two private parties agree to submit their dispute to one or more impartial individuals, known as arbitrators, for a final and binding resolution. The decision reached by the arbitrator is known as an “award” (Gordon, 2016). The process of arbitration is like a trial in many ways, but it is often quicker, less formal, and less expensive. During the arbitration, both parties present evidence and make arguments to the arbitrator in support of their position. The arbitrator then decides based on the evidence and arguments presented, and this decision is binding on both parties (Gordon, 2016).While arbitration has no set requirements, there are several common organizations used by many throughout the world who have a common set of rules of engagement. For international disputes, a popular arbitration option is the ICC, or the International Chamber of Commerce and for domestic disputes, the American Arbitration Association, or AAA (Gordon, 2016). Primarily, during the construction of the contract between two parties, the specifics of arbitration are outlined. These specifics can include specific rules, location, language, and the number of arbitrators (Gordon, 2016). The advantages of arbitration very well could be a great idea for legal proceedings for Colossal management. One of the key benefits of arbitration is that it allows parties to have more control over the outcome of their dispute. This is because the arbitrator is chosen by the parties, and the rules of arbitration can be tailored to the specific needs of the dispute. Therefore, Colossal could chose an arbitrator that has a background in a specific law or particular field that benefit Colossal if the corporation has to debate a case. This is also beneficial as the arbitrator chosen could easily be geographically separated from either part, such as the ICC in Paris, France. In doing so, the unbiased arbitrator would not have ties or sway in favor of a party in another country, unlike a court system based in the party’s home country (WIPO, n.d.).Another benefit for Colossal is that arbitration is often faster and less expensive than litigating in court. This is because the process of arbitration is less formal, and the parties do not have to go through the same extensive discovery process that is often required in a court case. Additionally, arbitrators can make decisions more quickly than a court, as they do not have the same backlog of cases that a court often has (Pimentel, 2022).Thirdly, the benefit of enforceability is greatly beneficial to Colossal, especially when dealing in international contracts. According to Gordon, “most of the world’s trading nations have agreed to have their courts enforce arbitral awards issued in foreign nations” (2016). This means the awards given by the arbitrator are almost absolute, and enforceable in any country that has signed the Convention on the Enforcement of Arbitral Awards, as only under rare circumstances are rewards overruled in a court of law. This absolute does however pose a disadvantage. Since the decision of the arbitrator is final and binding, and there is limited opportunity for appeal. This means that if the parties are dissatisfied with the award, they may have no recourse to have the decision reviewed or overturned. However, this slight disadvantage is drastically outweighed by the advantages of efficiency, enforceability, and controllability arbitration offers. In conclusion, the advantages of efficiency, enforceability, and controllability arbitration offers as well as having unbiased judgment with world-wide parties makes arbitration a grand idea for Colossal Corporation. Going forward, the VP should enforce all new contracts, domestic and international, have the particulars of arbitration outlined within them.

PROCESS INNOVATION In Module 3, you will focus on the main section Theories, Models, and Conceptual Framework. The first task is to review the Theories and Models you have chosen to use and also review your Research Questions as well as the overall Research Problem. Revise these elements of this main section as necessary. Make sure that your theories and models are a good fit to for finding answers to your research questions. Also consider the business knowledge domain in which the research problem is situated. Does the problem pertain to marketing, operations, logistics, IT, HR, management, leadership, decision making, or other domain of knowledge? Do your theories and models relate to this domain? Will the theories and models provide a basis for developing your research instruments (questionnaires, interviews, etc.) to collect data that will provide answers to the research questions with good analysis?Review and update your conceptual framework, which is an expansion of the concepts that follow from the theories and models, the research problem, and the research questions. What do we mean by conceptual framework, and more importantly, what do we mean by “concept”? Generally, the term concept refers to an idea about a specific thing which can be either concrete (tangible) or intangible. This thing has a definition which provides the characteristics that make it the thing. Ball is a tangible concept. Balls exist physically. And we can define what a ball is, that is, a (usually) spherical object used for play and in sports and in some industrial applications. Note there are many kinds of balls and each of these kinds has a more specific definition, such as baseball, football, tennis ball, ball bearings, etc. Leadership is an intangible concept. It is not a thing that can be held or touched. We can observe behavior of people and conclude that the behavior demonstrates leadership or not. Note there are different kinds of leadership (e.g., transformative, translational, military, permissive, etc.).In the context of DSP research, how are concepts determined and how are they used to create a conceptual framework? The concepts for the DSP, which are identified in Chapter 1, are expanded in Chapter 2. These concepts are connected to the theories and models, and the research questions. What are the ideas (concepts) that are relevant to the research problem and questions and the theories? One way is to start with the theories and determine the key or major ideas, concepts, variables, and terms that are part of the theory or model. Look at the research questions and consider some possible answers. Of course, you will find the actual answers from the data you collect and analyze. But by projecting some possible answers you can find additional concepts or ideas that are relevant to the research. There are several ways to create the framework, but the simplest and most practical is a list or taxonomy of the concepts. These concepts can become a section or sub-section headings in Chapter 2.Once you have identified some key concepts, you can use these as search terms to find literature—that is, research papers, articles, websites, books, etc.—that provide discussion of previous research, findings, key results, definitions, and other information. As you review these works of literature, look for additional concepts that are related. Add these additional concepts to your taxonomy and continue to search.Searching for literature can be a tedious process. With the availability of most of the literature via electronic means (using the internet) and most materials available for downloading, you will find a large number of possible items, and many of them may not be useful. You can narrow down the search by using more specific search terms. And you can scan the results by reviewing the abstract. When you find an article in the library, it is possible to flag that item to save it. And when you are done with a session, you can have those flagged items sent to you in an email with the reference information included. However, you should take some time to review those items in more detail to determine if they are relevant and note how they are relevant to your own research. If the literature item is a research paper, note the kind of research, and what the hypotheses or research questions were. How was the data collected and analyzed and what were the key findings? Also, what were recommendations for future research and was there anything that was missing or incomplete? When you find literature that is relevant and pertains to one of the concepts in the outline, add it to the Lit Review Annotated Outline using APA format along with a notation about how each item is relevant to your review. In the Progress Report section of the Lit Review Outline under SLP 3 – Theories, Models, and Conceptual Framework, write a paragraph that discusses your search efforts, problems, and successes, and indicate what you think you still need to do for this section. Include a paragraph that provides an introductory review of one of the literature items from this main section.Progress ReportSLP 3 – Theories, Models, and Conceptual Framework progress[paragraph discussing progress][introduction paragraph of one article]When you have found a sufficient amount of literature and updated the Lit Review Outline document including the Progress section, upload it to the SLP3 Dropbox.Choose one, two, or three:O’Neill, P., Sohal, A. Marketing Strategies The Pursuit of Happiness Paper

For this assignment you should watch a movie, or re-watch a movie you remember seeing in the past. In any number of movies I can think of there is a leader who, by articulating a vision and a challenge to others to see it happen, convinces followers to join them in trying to achieve something. The leader then organizes the activities and motivates followers to help the entire organization achieve the vision. There are plenty of sports movies (e.g., Coach Carter, Remember the Titans), action movies (Oceans 11, The Italian Job), and animated movies (e.g., Toy Story, A Bugs Life), where some leader(s) create a compelling vision for others to follow and lead others to success. In the paper, take 500-750 words to describe the basic plot of the movie (in your own words!). Then, for the rest of the paper, using some of the terms and ideas described in the chapters, explain how the leader(s) contributed to success. Be sure to describe specific scenes in the movie (cite these using the time elapsed since the start of the movie, e.g., 52-53 minutes), and cite specfic pages of the textbook chapters that refer to the concepts in the book that help explain the success of the leader(s). Feel free to use other sources of information to further understand and describe theories. For example, the Path-Goal Theory may be a very powerful concept for understanding a particular leader’s success, but since this is covered in less than one page in the text book, it may be necessary to access a few more sources to fully apply this theory. This paper should be around 1800-2500 words, with proper referencing of all sources used. I recommend using the APA format for the paper and references, although I am not a stickler for following every detail of the official formating guidelines. The library or the writing center can provide assistance if you have any questions. There are also a number of sources of information regarding this standard, including
