Discuss two exceptions to the exclusionary rule.

1st Part
Deliverable Length: 2-3 paragraphs
ÿ
Police officers are required to follow the Constitution. Many amendments that make up the Bill of Rights deal with law enforcement related issues and explain the rules that the police must follow.ÿInterpretation of the Constitution occurs when cases are challenged in court.ÿThe 4th Amendment requires that people in the United States are free from unreasonable searches and seizures.ÿWhen the trial court establishes that a defendant?s constitutional rights were violated, the judge can rule to exclude the illegally obtained evidence.ÿThis is applying the exclusionary rule.ÿThroughout the years the courts have also established exceptions to the exclusionary rule which means illegally obtained evidence may still be accepted as evidence in a criminal trial.

Discuss two exceptions to the exclusionary rule.
Provide an example of each of these exceptions.
Discuss if you agree or disagree with these exceptions to the exclusionary rule.

2nd Part
Deliverable Length: 2-3 paragraphs
ÿ
The U.S. system of government and criminal justice system place certain authority and responsibility upon the law enforcement officer, the prosecutor, and the judge. Each individual has various degrees of discretion that can beÿexercised in performing duties at different times during each stage of a criminal procedure. The exercise of discretion can have a tremendous impact on the manner in which a criminal case is investigated, prosecuted, or sentenced.
Part 1: Provide concrete examples of when and how each of these officials of the criminal justice system (law enforcement officer, the prosecutor, and the judge) may appropriately exercise discretion at theÿsix stages of criminal procedure:

The investigation stage
The arrest stage
The pretrial stage
The trial stage
The appeal stage
The serving the sentence stage

Remember that one or more of these officials will have little or no involvement in allÿsix stages of criminal procedure; however, for each stage, indicate which official has the power to exercise discretion and how that discretion can be legitimately exercised by that official.
Part 2: Then, suggest guidelines that are now, or that could legitimately be, imposed by law to limit the arbitrary use of each official?s power of discretion. Provide support or examples for each of the guidelines that you have suggested.

Organizational culture with the wrong tolerance

ÿ
Read the organizational scenario for this discussion in the Unit 8 Discussion Scenarios document, linked in the Resources. Respond to the following:

What can the HR VP do to present these leadership challenges to the new CEO as they are and take a rational approach to the situation that balances the new CEO?s leadership philosophy with effective employees? Please do not use standard transactional approaches in your response, such as progressive discipline for both supervisors.

Scenario:
ÿÿ
Discussion 2: Organizational Culture With the Wrong Tolerance
For this discussion, the new CEO comes to you and tells you that he is a positive person, but there are things he wants you to know that he is very much against. Among them is tolerance for highly capable employees who are bullies or insensitive to others.
When he tells you this, you know right away things are about to get really difficult for you, because you have two senior leaders, both division chiefs with over 60 employees, whom you suspect meet the CEO?s criteria for undesirable behavior.ÿ
One of the division chiefs is a quiet, highly focused professional who never raises her voice but consistently has employees coming to your office to tell you that this supervisor is persecuting them. The complain that she checks all they do, goes through their cubicles, is highly critical in meetings, and gives them special duties requiring them to stay late and come in early. There has been a rumor that this supervisor was making employees inspect bathrooms to insure the custodial staff did their job, but you never could confirm it.ÿ
The other supervisor has an effective organization and seems to have divided his organization into two groups. One group he seems to like and identify with. The other group he consistently complains about to peer leaders, because he thinks they cannot seem to do anything right, although you know the second team is equally as productive as the preferred group.

Explain concisely in your own words what you believe are the key features of an EP approach, comparing these features with the IRM Risk Management Standard. Focus your explanation on the Concept Stage of the project lifecycle. Very briefly explain what the key features of the EP approach and the main differences with the IRM Risk Management Standard. In this section, it is important that you show your understanding of the four frameworks and how they are interrelated. In your narrative explain how you would approach a new project using the four frameworks. Feel free to use examples to demonstrate your understanding of the subject. Your answer should be based on the material discussed in the lectures and presented in the recommended reading.
Part 2 25% of the total marks 1000 words maximum
For the structure (all uncertainty) phase of the EP approach, in the Concept strategy progress stage of a project?s lifecycle, explain concisely in your own words what you believe are the key features of an EP approach, briefly comparing these features with the IRM Risk Management standard. Your discussion should demonstrate your ability to understand a particular area of the course material in depth, based on selective reading, critical analysis and the case study exercises. Use examples to illustrate your discussion if you wish but concentrate on concepts and principles.
Part 3 25% of the total marks 1000 words maximum
Select a different phase of the EP approach, now in the execution and delivery stage of the project lifecycle. Apply the SPP to a project of your choice. Discuss the challenges and benefits of the SPP process. Draw on published literature to support your arguments. Explain why you have chosen this phase. To show your understanding of this phase of the SPP compare this phase to an analogous phase in the IRM Risk Management Standard.

Healthcare finance & budgeting – operating budget

ÿ
This course explores healthcare specific financial policies and issues, analytical framework and economic transformation for financial decisions (such as investment and working capital), methods of financial management, insurance coverage and financing. In addition, the course focuses on the ability to apply economic and population health models to address health service issues and problems.
You will use the knowledge gained in this course to financially structure and evaluate the opening of a private primary care medical practice with one physician provider. You will prepare an operating and capital budget as well as a narrative summary of at least 1,000 words to show your financial findings and recommendations. You will provide supporting documentation to support your findings and recommendations.
Prior to writing your narrative summary you will need to prepare an operating and capital budget for the project. The well-prepared operating and capital budgets will demonstrate a keen knowledge of the market, pricing, activity, revenues, expenses, and potential impact on cash-flow and/or profitability. The capital budget will similarly demonstrate an awareness of the capital items and associated costs for project start-up.

Prepare an annual statistical report that includes the following:

Volume of patient visits
Revenues (percentage of reimbursement from Medicare, Medicaid, Commercial Insurance and Self Pay)
Expenses (Labor, Equipment, Supply, Overhead)
Provide your assumptions to justify all volumes, revenues and expenses

Prepare a three-year operating budget that includes the following:

An estimate of revenue each year
An estimate of expenses for each year
The cash flow (negative or positive) generated from revenues and expenses

Prepare a start-up capital budget listing the equipment you may need for this project including the cost and annual depreciation
From your operating budget calculate the following:

Projected cash flow over 3 years
Break-even analysis
Internal rate of return (IRR)
Net present value (NPV)

From your calculations, evaluate the financial risk involved with this project and make a recommendation as to whether this project is financially viable.
Prepare a 1000-word minimum narrative summary of your financial findings and recommendations. You will provide supporting documentation to support your findings and recommendations.

reflective questions | FNP | MRU

ÿSandra, a 47-year-old divorced woman, received a diagnosis of stage 3 ovarian cancer 4 years ago, for which she had a total hysterectomy, bilateral salpingo- oophorectomy, omentectomy, lymphadenectomy, and tumor debulking followed by chemotherapy, consisting of cisplatin (Platinol), paclitaxel (Taxol), and doxorubicin (Adriamycin). She did well for 2 years and then moved back to her hometown near her family and underwent three more rounds of secondline chemotherapy. She accepted a less stressful job, bought a house, renewed old friendships, and became more involved with her two sisters and their families. Sandra developed several complications, including metastasis to the lungs. Then she could no longer work, drive, or care for herself. She had been told by her oncologist that there was nothing else that could be done and that she should consider entering a hospice. She met her attorney and prepared an advance directive and completed her will. She decided to have hospice care at home and, with the help of her family, set up her first floor as a living and sleeping area. She was cared for by family members around the clock for approximately 3 days. Sandra observed that she was tiring everyone out so much that they could not really enjoy each other?s company. At this time, she contacted the Visiting Nurse Association (VNA) to seek assistance. Her plan was to try to enjoy her family and friend?s visits. After assessment, the VNA nurse prioritized her problems to include fatigue and caregiver role strain. Other potential problem areas that may need to be incorporated into the care plan include anticipatory grieving and impaired comfort.
ÿReflective Questions 1. What are some of the stresses on Sandra?s middle-aged sisters and their families? 2. What resources are available to manage these stresses and support the sisters while caring for their dying sister Sandra? 3. Describe Sandra?s feelings about dependency and loss of autonomy because she is unable to do her own activities of daily living any longerÿ
